Showalter Quoted on Federal Court Test of Toxic Substances Act and NGO Influence

Partner J. Michael Showalter was quoted on a California federal court case that will test the influence of citizen and non-governmental organizations under the Toxic Substances Control Act (TSCA). The citizen suit provision aims to force the U.S. Environmental Protection Agency (EPA to regulate chemicals it has previously deemed safe.

Mike said that although the Northern District of California federal courts regularly handle environmental litigation, this citizen suit is the first to present an in-depth challenge of an EPA TSCA determination.

“[Federal] judges … are used to … business disputes, Social Security disputes, and then lots of cases involving drugs and guns,” he said. “So seeing a case like this play out in court is unique for a whole variety of reasons.”
