Loring Quoted on EPA's New Rule Pressuring Decisions on Coal Plant Futures

Partner David Loring was quoted by Law360 discussing the impact of the US Environmental Protection Agency’s (EPA) final rule limiting greenhouse gas emissions from power plants.
David explained that due to the time required to secure permits and implement Carbon Capture and Storage (CCS), as well as the obligation for states to submit compliance plans within two years of the final guidelines being published, the EPA is pressuring coal plant owners to make decisions about the future of their plants.
“The way the EPA has structured this is to say to the coal industry, ‘You’ve got to make a decision, and if your decision is to continue to operate, you don’t get out of jail simply by repowering,’” he said.
