Loring Quoted on EPA Restoration of Legal Basis for Mercury Regulation

Partner David Loring was quoted on the Biden Administration and U.S. Environmental Protection Agency’s (EPA) restoration of the “appropriate and necessary” finding that provides the legal basis for Mercury and Air Toxics Standards, the language of which had been removed by the previous administration in 2020.

New research shows that mercury may be worse than previously anticipated, and even more so for environmental justice communities, which David said is likely “a significant driver” when considering justifications for rules like mercury standards under the Biden Administration.

He added that the EPA restoring of the finding affirms the agency’s ability to consider additional and more qualitative factors that could be used to support a stronger rule.
