Arent Fox Partner Linda Baumann Comments on Potential Repeal of Stark Law
Health Care partner Linda Baumann was quoted extensively in Bloomberg BNA’s Health Care Fraud Report in an article on the potential repeal and overhaul of the Stark Law.
The article “Senate Finance Mulls Overhaul of Fraud Law” provides perspectives on suggested changes to the law, outlined in a 20-page report issued by the Senate Finance Committee.
Linda notes that the Committee’s consideration of suggestions to repeal all or part of the Stark Law is particularly significant since this would have been unheard of just a few years ago.
Linda also surmised that the Finance Committee will likely start by considering changes to the Stark Law that facilitate implementation of alternative payment methodologies and that better define technical violations so that they do not result in devastating penalties.
