ArentFox Schiff formed its cross-practice Data Ethics team to help organizations build policies and practices that foster effective and responsible use of data assets. The need for ethical data practices is especially important amid the rapid proliferation of machine learning, artificial intelligence, and other algorithmic-based technologies, which are often invisible to individuals whose data are processed.

Our Focus

Our Data Ethics team helps clients identify goals for their data assets, understand legal obligations associated with these goals and embed data ethics throughout the data lifecycle to enable safe and transparent data use.

Our team includes lawyers with deep experience in Cyber Policy, Cybersecurity, Privacy and Data Protection, Health Care, Labor & Employment, Marketing and Advertising, Patent, and Technology Transactions, all of whom work together to offer practical and strategic guidance across myriad industries.

Our Work

While privacy laws have advanced ethical processing of personal data through more robust notice and consent requirements, effective data ethics practices consider more than consent.  Our Data Ethics team not only helps clients to understand and deploy effective notice and consent tools but also to protect data from unauthorized use, to determine whether and when data use and sharing are consistent with the scope of consent and to identify and meet ethical goals.  For new technologies in particular, we help clients protect against re-identification of data and bias risks and promote transparency and accountability at all levels.
