Grimm Quoted on Increased State Access to 340B Drug Discounts

Health Care Practice Leader Douglas A. Grimm was quoted on pharmaceutical manufacturers easing restrictions on 340B drug discounts as more states attempt to make the program’s benefits accessible.

The rise in state laws is partly in response to more than two dozen pharmaceutical manufacturers restricting 340B discounts on prescriptions filled by contract pharmacies. The drugmakers limited the discounts after winning several lawsuits challenging the federal government’s authority to compel discounted drugs.

“The contract pharmacy issue is just one of many heavily litigated areas of the 340B program,” Douglas said. “The federal government may try to step in and clarify the statute, but the states aren’t sitting around and waiting for Congress.”

The most recent state to enact legislation is Missouri.

Douglas said, “Missouri won’t be the last state to pass one of these laws.  But state laws will continue to be challenged in court and the issue on a federal level is going to be forced.”
