Aaron Jacoby quoted in Automotive News article on Takata recall
Arent Fox Partner and Automotive Practice Group Leader Aaron Jacoby was quoted in a recent Automotive News article, “Repair shops could get airbag recall work.”
The article discusses the possibility of nondealer service shops assisting in the replacement of 23 million defective Takata airbag inflators. The National Highway Traffic Safety Administration is considering this option in response to the most complex auto safety recall effort in U.S. history, which involves 19 million U.S. vehicles made by 12 automobile manufacturers.
However, implementing such a plan would be difficult in light of Takata’s supplier contracts in an industry that is heavily regulated by law. Aaron noted, “There are numerous statutory, practical, business and contract hurdles to overcome that would negate any perceived benefit of going forward with such a plan.”
