AFS Automotive Group Advises Dalia Auto Group in Palmdale Kia Transactions and Litigation
ArentFox Schiff successfully advised Dalia Auto Group with the sale of a Kia dealership in Palmdale after litigating for more than a year in federal court and before California’s New Motor Vehicle Board against Kia to preserve the franchise.
The dealership’s assets were owned by Rally Auto Group which was contractually obligated to sell to Dalia Auto Group until Kia refused to approve Dalia’s application for a Kia franchise, which sparked the litigation. The dispute with the manufacturer was ultimately resolved by the sale of the dealership assets and underlying real estate to a third party more than a year later. ArentFox Schiff handled both the transactional and litigation aspects of the matter while the client was able to preserve the dealership’s operations and goodwill.
