AF Automotive Succeeds in Fighting Off FEHA Claims for California BMW Dealership
AF Automotive successfully represented a California BMW dealership in an action for alleged violations of the Fair Employment and Housing Act or “FEHA” (Cal. Gov’t Code §12940, et seq.) asserting claims for failure to provide an accommodation (Cal. Gov’t Code §12940), discrimination (race, sex, and pregnancy), prevention of discrimination, wrongful termination, retaliation and harassment).
The FEHA action was filed by a former Service Manager against the dealership and its President after she was terminated for misconduct. At the arbitration, AF counsel Aaron Jacoby and George Koumbis showed that Claimant was terminated for insubordination and that there were no FEHA violations. The six-day arbitration resolved five years of hotly contested litigation. The Arbitrator, Judge Richard Stone with Signature Resolution, issued an Arbitration Award in favor of the McKenna BMW dealership and its President on the entirety of the FEHA action.
