Fredrick Weber and Jessica Birnbaum will present at the Illinois Institute for Continuing Legal Education (IICLE) – 66th Annual Estate Planning Short Course on May 22 and 23, 2023.
In their presentation, “RUFADAA, Bitcoin & Fiduciaries: Finding the True Meaning of ‘Digital Assets’ in Estates & Trusts,” Fred and his co-presenter will discuss issues that fiduciaries need to address as digital assets and cryptocurrency become more common. The presentation will also address issues related to accessing digital asset information following a death and explore the many fiduciary challenges that may arise in estates and trusts that hold cryptocurrency, NFTs, and other blockchain-based digital assets. Related topics will include finding and taking control of digital assets, estate and gift tax valuation and tax treatment of digital assets, how to plan for them, and how fundamental trustee duties are implicated by the presence of these new and complex assets.
In the session “Best Practices for Fiduciary Communications During Estate (and Trust) Settlement - Striking Balance Between What’s Required & What Actually Works,” Jessica Birnbaum and her co-speaker will discuss how to navigate communication and information sharing during the estate and trust settlement process, from filing the will, to asset distribution and everything in between. They will explore whether compliance with the statute is enough to keep the waters calm.
