Client Work
Don assists clients in defending their pesticides and other crop protection tools and the products of biotechnology through counseling, agency submissions, and litigation pursuant to several statutes, including the:
- Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA)
- Federal Food, Drug, and Cosmetic Act
- National Environmental Policy Act
- Endangered Species Act
- Plant Protection Act
Don frequently advises clients on and litigates data use and compensation disputes under FIFRA.
He also assists clients in defending against product liability claims and securing insurance coverage for those claims.
In addition, Don strategizes with vehicle industry-related trade associations and manufacturers with respect to antitrust, contract, and product-related issues.
Previous Work
Don joined ArentFox Schiff in 1987 after serving for six years as a federal prosecutor in the Criminal Section of the Tax Division of the United States Department of Justice.
Publications, Presentations & Recognitions
In February 2020, Don received the Marc L. Fleischaker Pro Bono Award For Outstanding Contributions to the Public Interest.
While working at the Department of Justice, Don received two Department of Justice Outstanding Attorney Awards for his work in prosecuting cases involving criminal tax and other white collar offenses.
