Horwich Discusses Insider Trading and Clinical Drug Trials
The CLS Blue Sky Blog, Columbia Law School
In a blog for the Columbia Law School’s Corporations and the Capital Markets, AFS Partner Allen Horwich and Northwestern University Associate Vice President for Research Crista Brawley present highlights from their previously published case study. This includes how insider trading law has been applied – and may be applied – in a regulated industry where there are many actors in different roles with access to material nonpublic information (MNPI).
Allan and Crista’s blog presents critical issues in the legal framework of insider trading law, the regulatory process for drug approval by the Food and Drug Administration (FDA), and insider trading cases in that setting. They go on to address how the law might apply to a broad array of scenarios. They also discuss areas of uncertainty and recommended steps to reduce the risk of wrongful conduct.
